These Terms of Use and Legal Disclosures (“Terms of Use” or “Terms”) apply to the access to and use of the website located at www.acs.org and all associated web pages, websites and corresponding social media pages, any web pages, websites and corresponding social media pages (including all content therein) that directly reference these Terms, the American Chemical Society (ACS) Network, and any other web page, features, sponsored content, tools, blog, interactive sites(s), services or other materials or means of interaction and information (collectively referred to as the “Services”, as appropriate) made available by the American Chemical Society, its subsidiaries and affiliates (each “American Chemical Society”, “ACS”, “we”, “us” or “our”). 

Please review these Terms carefully before using Services. ACS may revise these Terms at any time and you agree that, by visiting, using or interacting with any Services, that you are bound by these Terms and any changes from time to time; or, unless you or the institution on whose behalf you are using the Services have entered into a separate agreement with the ACS, in which case the terms of the latter shall prevail. ACS may also change or discontinue any Services and information on any Services at any time, and may also block or discontinue your use of the website or Services for any reason.

References to “you,” “your” or “User” in these Terms will refer to both the individual accessing, viewing, downloading or otherwise using the Services and to any such Organization.

By accessing, viewing, downloading or otherwise using any services you agree to these terms, together with our Privacy policy AND/OR ACS CANDIDATE PRIVACY STATEMENT (AS APPLICABLE). however, if you do not agree to these terms, do not JOIN THE ACS NETWORK AND DO NOT ACCESS, VIEW, DOWNLOAD, OR OTHERWISE use any OF THE services. USE OF THIS SITE CONSITUTES YOUR BINDING AGREEMENT WITH ITS TERMS. NOTHING IN THESE TERMS SHALL BE DEEMED TO CONFER ANY THIRD-PARTY RIGHTS OR BENEFITS. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS, YOU MAY NOT USE NOR ACCESS OUR SERVICES. 

 

Your Responsibilities
In exchange for your access to, use of, or interaction with the Services and the content we make available, you agree (a) to use all Services in accordance with the terms and conditions of these Terms; (b) that all information you submit, if any, is truthful and accurate and that you are responsible for maintaining the accuracy of your information; (c) have not previously been suspended or removed from the Services; (d) do not have more than one account at any given time; (e) that you will not submit any personal information if you are under 13 years of age; (f) have the full power and authority to enter into these Terms of Use and in doing so will not violate any other agreement to which you are a party; and (g) that you will not use any Services in a manner that violates any applicable law or regulation, to harass others, or to spread misinformation. 

Use of Materials and Information on Services
The entire contents of the Services, includes, but is not limited to, text, data, graphics, images, photographs, maps, illustrations, trademarks, tradenames, service marks, logos, button icons, HTML code, information, methodologies, processes, tools, advice, and other materials originally created by ACS, contributed to and/or obtained from ACS’s licensors and partners (collectively “Content”). Title to the Content on the Services remain with ACS, its licensors and/or its partners. ACS invites you to view, use and share a copy of the materials obtained from any Services for non-commercial purposes. User agrees not to remove or obscure copyright notices appearing anywhere in or on the Services. ACS grants no copyright or ownership interests to User for any of the material and proprietary information referred herein belonging to ACS. Permission to use Content may be granted in special circumstances on a case-by-case basis. Please direct any request to use content to help@acs.org. Citation to ACS materials in a document or communication may not be used to imply or constitute endorsement or approval by ACS.

Use of any ACS Content by you does not constitute an endorsement of you, your organization, your research, or your conclusions by ACS. You may not state or imply that ACS has in any way endorsed or otherwise approved your use of ACS Services Content.

Linking to ACS Content and Services
We encourage sharing of our content with others and you may include links to the ACS Content and Websites but must adhere to the following: (i) the appearance, position and other aspects of the link may not be such as to alter, damage or dilute the American Chemical Society’s name(s) and trademarks or the goodwill associated with them, (ii) the appearance, position and other attributes of the link may not create the false appearance that you or your organization or entity are sponsored by, affiliated with, endorsed by, or otherwise associated with the American Chemical Society, and (iii) when a link you have posted is selected by a user, the link must display this website on full-screen and not within a “frame” on the linking website. American Chemical Society reserves the right to revoke its consent to the link at any time and in its sole discretion. Use or misrepresentation of any of the name of ACS or its logos, designs, images, photographs, slogans, trademarks or service marks in conjunction with the external links is not permitted and may further constitute violation of US and international laws, and ACS reserves all rights thereunder. 

Joint Projects
ACS sometimes partners with third parties on joint projects that may result in content that is shared among the parties or owned by another party (“Joint Projects”). Content available through Joint Projects may have additional terms and conditions or other policies about access and use of Joint Projects websites and content. Your access to and use of any Joint Projects materials is subject to the respective Joint Projects policies.

User Submissions
You do not have to submit anything, but if you choose to submit something (including any user-generated content, ideas, concepts, techniques and data, you must grant, and you actually grant by agreeing to these Terms of Use, a non-exclusive, irrevocable, worldwide, perpetual, unlimited, assignable, sublicensable, fully paid up, and royalty-free right to ACS to copy, prepare derivative works of, improve, distribute, publish, remove, retain, add, and use and commercialize, in any way now known or in the future discovered, anything that you submit to the ACS, without any further consent, notice and/or compensation to you or any third parties. By submitting any information to the ACS, you represent and warrant that the submission is accurate to your best knowledge, not confidential, and not in violation of any contractual restrictions or other third-party rights. ACS is under no obligation to exercise control over any content you or others submit when using the Services.

User Conduct with Services
User agrees to comply with all applicable laws, as well as with these Terms of Use. Some Services may offer Users an opportunity to share knowledge and post other helpful and meaningful information. You acknowledge and agree that such submissions are non-confidential for all purposes. By submitting content, comments, or information of any kind, you automatically grant ACS and its partners a full, worldwide, royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, publish, translate, create derivative works from, distribute, transmit, perform, and display your content (in whole or in part). You also represent and warrant that you own and/or that you have the right to share such content and to grant the license set forth above. ACS IS NOT RESPONSIBLE FOR THE MISUSE OR MISAPPROPRIATION OF ANY CONTENT OR INFORMATION THAT YOU SUBMIT.

Prohibited Conduct
You may not access, use, or attempt to access or use the Content or Services to take any action that could harm ACS or any third party, interfere with the operation of the Services, or use the Services in a manner that violates any laws. For example, and without limitation, you may not:

  • Claim the Content or Services as your own nor may you copy, sell, or otherwise distribute any Content or Services in exchange for money or anything else of value.
  • Modify, alter, or create derivative works from, transfer, re-sell, or otherwise distribute any of the material contained in or on the Services or Content without prior written permission from ACS.
  • Use or upload our Content or Services into artificial intelligence tools or technologies such as large language models and generative AI.

  • Post any false or inaccurate biographical information, delete or change any information posted by another person, and share User’s password with any third party.
  • Do anything that interferes with the proper working ability of the Services. This includes activity that can overload the Services’ infrastructure, use of software or other device other than that which is available from ACS, tampering with the software that makes up the Services, and destroying or changing information posted by any other person.
  • Post material that is copyrighted without first obtaining proper written consent from the copyright owner.
  • Post content or initiate communications which are unlawful, libelous, abusive, obscene, discriminatory, or otherwise objectionable.
  • Use the Services for any illegal purpose, including but not limited to conspiring to violate laws.
  • Falsely state, impersonate, or otherwise misrepresent your identity, including but not limited to the use of a pseudonym, or misrepresenting your current or previous positions and qualifications, or your affiliations with a person or entity, past or present.
  • Upload, post, email, transmit or otherwise make available any content or initiate communications which include information that you do not have the right to disclose or make available under any law or under contractual or fiduciary relationships (such as insider information, or proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements).
  • Upload, post, email, transmit or otherwise make available any content or initiate communication that infringes upon patents, trademarks, trade secrets, copyrights or other proprietary rights.
  • Upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation.
  • Upload, post, email, transmit or otherwise make available any material that contains software viruses, or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
  • Stalk or harass anyone.
  • Forge headers or otherwise manipulate identifiers in order to disguise the origin of any communication transmitted through the Services.
  • Post content in fields that are not intended for that content. Example: Putting an address in a name or title field.
  • Interfere with or disrupt the Services or any activity conducted on the Services or servers or networks connected to the Services, or disobey any requirements, procedures, policies or regulations of networks connected to the Services.
  • Attempt to probe, scan, test the vulnerability of, or breach the security of any system or network.
  • Engage in unauthorized spidering, “scraping,” or harvesting of content or personal information, or use any other unauthorized manual, automated, or other process means to compile information.
  • Monitor or copy, or allow others to monitor or copy, ACS web pages or the content included in the Services.
  • Attempt to decipher, decompile, disassemble, or reverse-engineer any of the software comprising or in any way making up a part of the Services.
  • Take any action that imposes an unreasonable or disproportionately large load on our network or infrastructure Frame” or otherwise simulate the appearance or function of the Services.
  • Engage in any other conduct that restricts or inhibits any person from using or enjoying the Services, or that, in our sole judgment, exposes us or any of our users, affiliates, or any other third party to any liability, damages, or detriment of any type.

Violations of system or network security may result in civil or criminal liability. We may investigate and work with law enforcement authorities to prosecute users who violate these Terms. We may suspend or terminate your access to the Services for any or no reason at any time without notice.

Registration and Password
You may be assigned a username and password with which to access restricted areas of some of the ACS Services. Users are responsible for maintaining the confidentiality of their information and password. User is responsible for all use associated with User's registration and the compliance with all Terms of Use. You are prohibited from selling, trading or otherwise transferring your account or any information therein to another party or charging anyone for access to the Services. If you knowingly provide your login and password information to another person, your account privileges may be suspended temporarily or terminated. You agree to immediately notify ACS of any unauthorized use of your password or account or any other breach of security. You are solely responsible for any and all uses of your username and password.

Email
Email submissions over the internet may not be secure. Please do not email American Chemical Society any personal or confidential information. Please refer to our Privacy Policy and ACS Candidate Privacy Statement for information on how ACS uses your information.

Services sponsored and controlled by the American Chemical Society are operated from the United States. ACS makes no representation that the Content of any Services is available or appropriate for use in other locations. Those who choose to access this website and/or Services outside the United States do so on their own initiative and are responsible for compliance with applicable local laws.  Recognizing the global nature of the Internet, you agree to comply with all applicable local rules including but not limited to rules regarding online conduct and acceptable content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside.

Children
ACS’s websites are not directed toward children under 13 years of age nor does ACS knowingly collect information from children under thirteen. If you are under thirteen, please do not submit any personally identifiable information to the American Chemical Society.

Privacy Policy
By agreeing to these terns, you acknowledge that ACS may collect, use and disclose your personal information  as described in our Privacy Policy or ACS Candidate Privacy Statement, as applicable, associated with these Terms of Use.

Termination of Account
ACS reserves the right, at its sole discretion, to pursue all of its legal remedies, including but not limited to deletion of User's submissions. In addition, ACS may, with or without cause, immediately terminate User’s account and access to the Services without prior notice. Without limiting the foregoing, the following will lead to a termination by ACS of a your use of the Services (a) breaches or violations of these Terms of Use or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by you (self-initiated account deletions), (d) unexpected technical issues or problems, and (e) extended periods of inactivity. Termination of your account includes removal of access to all offerings within the Services and may also bar you from further use of the Services. ACS shall not be liable to you nor any third party for any termination of your account or access to the Services.

American Chemical Society, ACS, the ACS, and all other ACS logos and names of  American Chemical Society programs and services referenced herein are registered or common law trademarks of the American Chemical Society in the United States and other countries. Unauthorized use of any American Chemical Society trademark, service mark, or logo may be a violation of federal and state law in the US and other countries.

Release and Indemnity
You  hereby forever release American Chemical Society from any claims of whatever kind or nature you may have against us now or in the future related to or arising out of your use of any website or Services, Content, or third-party websites you access via links on ACS Services. Security
ACS cannot guarantee the confidentiality of any communication or material transmitted over the Internet or other global communication network and ACS is not responsible for the security of any information transmitted via the Internet, the accuracy of the information contained, or for the consequences of any reliance on such information. You must make your own determination as to the risk of these interactions.

Please also be aware that certain interactive functionality of some of the Services are open sites and you have no reasonable expectation of privacy while using sites with such features. ACS may obtain access to, block, disclose, and review electronic transmissions and communications made through the interactive features of any ACS Services at any time. Actual or attempted unauthorized use of any website or Services functionality may result in consequences from being blocked up to criminal and/or civil prosecution, including, without limitation, punishment under the Computer Fraud and Abuse Act of 1986.

ACS also reserves the right to view, monitor, and document activity on the user-generated content functionality without notice or permission from you. ACS Communications
In the course of providing you services, ACS may need to communicate with you via email (see our Privacy Policy to learn more about communications). You agree to receive emails which are specific to your account and necessary for the normal functioning of the Services. You also agree to have your name and/or email address listed in the header of certain communications which you initiate through the Services.

Monitoring and Enforcement
While we have the right to monitor activity and content associated with the Services, ACS is not obligated to do so. Because community standards vary and individuals sometimes choose not to comply with ACS policies and practices, in the process of using our Services, you may be exposed to content that you find offensive or objectionable. You can contact our Customer Service Department to let us know of content that you find objectionable. We may investigate the complaints and violations of our policies that come to our attention and may take any action that we believe is appropriate, including, but not limited to issuing warnings, removing the content or terminating accounts and/or subscriptions. However, because situations and interpretations vary, we also reserve the right not to take any action.
